Terms and Conditions

THE FOLLOWING ARE THE TERMS AND CONDITIONS (“TERMS”) APPLICABLE TO THE DAILYPAY HEALTHCARE HEROES AWARD CONTEST (“CONTEST”) CONDUCTED BY DAILYPAY, LLC WITH ITS OFFICES AT 55 WATER ST., 42^nd FLOOR, NEW YORK, NY 10041 (“DAILYPAY”).  PARTICIPATION IS OPEN TO THOSE WHO MEET THE ELIGIBILITY REQUIREMENTS SET FORTH BELOW. VOID WHERE PROHIBITED BY LAW. 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THE CONTEST. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.  

BY SUBMITTING A NOMINATION OR PARTICIPATING IN THE CONTEST, YOU AGREE TO ABIDE BY THESE TERMS.  IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PARTICIPATE IN THE CONTEST. 

 1. Eligibility.  To be eligible to participate in the Contest, a nominated individual (“Nominee”) must meet all of the following eligibility requirements: (i) be eighteen (18) years of age or older (or the age of majority in your jurisdiction of residence if higher than 18); (ii) be a legal resident of the fifty (50) United States or the District of Columbia; (iii) be a healthcare professional; and (iv) be nominated by someone within his or her healthcare organization to participate in the Contest.

2. Entry Period. Nominations for the Contest will start at 12:00 AM on April 28, 2025 and close at 11:59 PM on May 9, 2025 (the “Entry Period”).  DailyPay reserves the right to close the Entry Period at any time or extend the Entry Period in its sole discretion.  

3. Nomination.  Nominations may be made by completing a submissions form at dailypay.com/healthcare-heroes/.  To be considered complete and eligible for participation in the Contest, the nomination must include all of the following information: (i) the nominator’s full name and contact information; (ii) the name and contact information, including email, of the Nominee; and (iii) a description of the Nominee’s contributions to the healthcare profession, which may include showing exceptional commitment and resilience in challenging situations, delivering compassionate care and creating positive results for patients, improving healthcare processes and keeping healthcare facilities running smoothly, among others.  There is a limit of one nomination per organization. Nominators may not nominate themselves.  Nominators are not eligible to participate in the Contest.  It is the nominator’s responsibility to ensure, prior to entering the Nominee into the Contest, to obtain the consent of the Nominee to the nomination and to sharing the Nominee’s personal and contact information with DailyPay. The nominations and their content must not disclose any confidential information, trade secrets, patentable subject matter, any account information or other personal data.

4. Winner Selection and Notification.  On or about May 11, 2025, a judge selected by DailyPay will review all nominations received and based on any lawful criteria it deems desirable select up to five (5) Nominees as  winners from the entries received during the Entry Period.  DailyPay will attempt to contact the selected Nominees via the email address provided in the submitted nomination.   If the potential winner cannot be contacted or does not respond within fourteen (14) calendar days of attempted email notification, prize will be forfeited and an alternate winner may be contacted. 

5. Prizes.  Each of the five (5) winners will be eligible to receive a prize in the form of a $500 Visa® gift card. The method of delivery of the prize will be determined at the sole discretion of DailyPay. DailyPay is not responsible for any prizes that are lost, stolen, undeliverable, or returned. Each winner’s rights to receive the prize are subject to verification of eligibility. The right to receive the prize cannot be transferred, assigned or redeemed for cash. The prize is non-transferable and no cash or other prize substitution is permitted, except at the sole discretion of DailyPay. The prize is subject to availability and if the prize cannot be awarded, for any reason, DailyPay reserves the right in its sole discretion to substitute a prize with one of comparable or greater retail value. Each winner is solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance and use of the prize. As a condition of receiving the prize, the winner must sign and return any documents requested by DailyPay, including but not limited to, an affidavit of eligibility and release of liability. Noncompliance with the requirements of this paragraph will result in disqualification of the winner and the forfeiture of all interest in the prize. All costs and expenses associated with prize acceptance and use not specifically provided herein are the responsibility of each winner. If any winner does not claim their prize by December 20th, 2025, then such winner will forfeit the prize.

6. Publicity.  Except where prohibited by law, by accepting a prize, the winner hereby grants DailyPay and its licensees a perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display for advertising and publicity purposes the winner’s name, hometown, likeness and photograph in any way, at any time, in any and all media, including, without limitation, for issuing a press release in connection with the Contest, without any additional approval or consideration.

7. Limitations of Liability.  DailyPay, its directors, officers, employees, contractors, representatives, and agents, and its parents, subsidiaries, or affiliated companies, marketing agencies, and any other parties involved in the administration of the Contest (the “DailyPay Parties”) assume no liability and are not responsible for, and by nominating a Nominee for the Contest or claiming or accepting any prize, you hereby waive and release the DailyPay Parties from, any actions, claims, damages, losses or injuries of any kind (collectively, the “Claims”) arising in connection with the Contest and/or the receipt, use or misuse of any prize, including without limitation, Claims relating to: (i) the malfunction of any computer, telephone, network, satellite, hardware, software or communications line; (ii) unauthorized human intervention; (iii) incorrect, delayed or inaccurate transmission, winner notifications, prize claims or other information or communications relating to the Contest, or the failure to capture or transmit any such information; (iv) damage to any person’s computer or mobile device; or (v) any errors in these Terms, winner notifications or other announcements or communications relating to the Contest. In the event of any ambiguity or error(s) in these Terms, DailyPay reserves the right to clarify or modify these Terms however it deems appropriate to correct any such ambiguity or error(s). In no event will more than the stated maximum number of prizes (i.e., 5 prizes) be awarded.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE (I) THE DAILYPAY PARTIES SHALL NOT BE RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES ARISING OUT OF OR CONNECTED WITH (A) THE CONTEST OR (B) ANY PRIZE AWARDED, AND (II) THE REMEDIES FOR ANY CLAIMS RELATING THE CONTEST ARE LIMITED TO THE ACTUAL OUT-OF-POCKET EXPENSES OF PARTICIPATION IN CONTEST (IF ANY).

ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A NOMINATOR OR NOMINEE, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, DAILYPAY RESERVES THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

DailyPay may prohibit a Nominee from participating in the Contest or winning the prize if, in its sole discretion, it determines that the nominator or the Nominee is attempting to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Nominees or any DailyPay Parties.

8. Reservation of Rights. If the Contest is not capable of running as planned, for any reason, including without limitation, due to a force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, government orders, natural disasters, the effects of COVID-19 or any pandemic or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, DailyPay reserves the right, at its sole discretion, to modify, suspend, or cancel the Contest. In the event of cancellation, DailyPay reserves the right to select the winners from all non-suspect, eligible entries submitted as of the time of cancellation or retain any and all prizes. DailyPay’s failure to enforce any term of these Terms shall not constitute a waiver of that provision.

9. Privacy.  Any personally identifiable information collected during an entrant’s participation in the Contest will be collected and used by DailyPay and its designees for the administration and fulfillment of the Contest and as otherwise described in these Terms and DailyPay’s privacy policy available at https://www.dailypay.com/legal/privacy.

 10. Disputes. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, your rights and obligations, or the rights and obligations of DailyPay in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules, and the forum and venue for any dispute relating to the Contest or these Terms shall be in New York County, New York.

 11. Agreement to Terms. By submitting a nomination or participating in the Contest, you agree to abide by and be subject to these Terms and DailyPay’s decisions, which are binding in all respects. DailyPay reserves the right to refuse, withdraw, or disqualify any Nominee at any time in its sole discretion. By participating in the Contest, you represent and warrant that you are eligible to participate based on eligibility requirements set forth in these Terms. You also agree to accept the decisions of DailyPay as final and binding as it relates to the Contest and the prizes.
